"Nikki, despite being the bio parent, will have to legally adopt him to ensure parental rights, just because we’re both women. Mad? Confused? Us too. The facts: While same-sex marriage is currently federally recognized, and Minnesota state law currently presumes parental rights for children of married adults, other states do not. Legislation and life can (and do) change. What if we move? What if the federal definition of marriage soon becomes “one man and one woman?” What if a medical emergency happens while we’re out of state? What if Katie, the “legal parent,” dies? They’re not fun to think about, but they are very real possibilities—and ones in which we’re not interested in having our legal status as parents challenged. So, rather than cross our fingers about something so important, we’re choosing to be proactive. The only way to guarantee both of our parental rights at the federal and state level is through second-parent adoption, a legal process that includes: - Petitioning Ramsey County courts for Nikki’s right to parentage of her own child - Background check for Nikki - A home study - A court hearing to formally approve or deny our petition All of this, of course, comes with a price tag. Because we’re not legal experts, we plan to hire an attorney with expertise in this area. Our goal is $2,000, which will cover attorney’s fees, background checks, court filings, and registry fees.
